Terms and Conditions of Use

Effective date: September 3, 2026 Last updated: September 26, 2026

1. Acceptance

These Terms and Conditions (the “Terms”) govern access to and use of the Molec application (the “Application”), owned by Yodai LLC (the “Owner”).

Downloading, installing or using the Application implies full acceptance of the Terms. Anyone who does not accept them must refrain from using it.

The processing of personal data is governed by the Privacy Policy, which forms an integral part of these Terms.

2. Description of the service

The Application offers features for planning and tracking physical training, logging food intake, integration with third-party health services and an automated conversational assistant that makes recommendations based on the recorded data.

3. No medical advice

The Application is not a medical device and does not provide healthcare services. Its content, including the proposed routines, the recommendations of the conversational assistant and the metrics displayed, is for informational and general fitness purposes and does not replace the diagnosis, advice or treatment of a qualified healthcare professional.

In particular:

  1. It is recommended to consult a healthcare professional before starting any exercise program, and especially in the case of a medical condition, pregnancy, recovery from an injury or ongoing drug treatment.
  2. Metrics derived from third-party devices (recovery, heart rate variability, sleep and similar metrics) are indicative estimates and have no diagnostic value.
  3. Physical exercise carries inherent risks, including the risk of injury. The user assumes these risks and is solely responsible for adapting the intensity to their condition and for stopping the activity at any warning sign.

4. Access requirements

The Application is intended for people over sixteen (16) years of age. Its use by people under that age is not authorized.

To use the Application, it is necessary to create an account. The user is responsible for safeguarding their credentials and for all activity carried out under their account, and must notify the Owner of any unauthorized use they become aware of.

5. Social features

Use of the features that allow information to be shared with other users is subject to the following conditions:

  1. Identity. The chosen alias may not impersonate third parties, mislead as to identity or be offensive. The Owner may remove aliases that breach this condition.
  2. Scope of sharing. Information is shared exclusively with the contacts expressly accepted and to the extent configured by the user.
  3. Conduct. Harassment, intimidation and any conduct harmful to other users are prohibited. The Application includes blocking and reporting mechanisms accessible from any contact’s profile. Reports are reviewed within a maximum of twenty-four (24) hours and may lead to the suspension or termination of the offending account.
  4. Non-commercial use. Use of these features for advertising, promotional or solicitation purposes is prohibited.

6. Permitted use

The user undertakes to use the Application in accordance with the law, the Terms and good faith. In particular, it is prohibited to: access third-party data without authorization; interfere with the operation of the service; reverse engineer the Application except to the extent mandatorily permitted by law; and automate access to the service without the prior written consent of the Owner.

7. User content

The data, images and texts provided by the user remain the user’s property. By providing them, the user grants the Owner a limited, non-exclusive and revocable license to store and process them for the sole purpose of providing the service, under the terms set out in the Privacy Policy.

8. Intellectual and industrial property

The Application, its code, its design, its content, its name and its distinctive signs are owned by the Owner or its licensors and are protected by intellectual and industrial property law. The user is granted a personal, non-transferable and revocable license of use, limited to the Application’s intended purpose.

9. Third-party services

The Application integrates with services provided by third parties, including Apple Health, WHOOP, Supabase and language model providers. Those services are governed by their own terms, which are outside the Owner’s control, and the Owner is not responsible for their availability or operation. The interruption of any of them may affect certain features of the Application.

10. Availability and changes to the service

The Owner may modify, suspend or discontinue the features of the Application, in whole or in part. Any material change will be communicated through the Application itself with reasonable notice.

11. Limitation of liability

The Application is provided “as is” and “as available”. The Owner exercises due diligence in its operation and in the protection of data, but cannot guarantee the absence of interruptions or errors, or the achievement of specific results.

To the extent permitted by law, the Owner shall not be liable for indirect, incidental or consequential damages arising from the use of the Application.

Nothing in this clause limits the Owner’s liability in cases where it cannot be excluded by law, affects the rights that consumer protection law grants to users, or relieves the user of the obligations regarding their own health described in section 3.

12. Suspension and termination

The user may stop using the Application at any time and request the deletion of their data in accordance with the Privacy Policy.

The Owner may suspend or cancel access in the event of a serious breach of the Terms, with prior notice unless urgency or a legal obligation requires otherwise.

13. Governing law and jurisdiction

These Terms are governed by Spanish law. Any dispute shall be resolved by the courts and tribunals that have jurisdiction under the applicable rules, respecting in all cases the venue that consumer protection law grants to the user.
